IHC summons IGP in drone attack case

ISLAMABAD – The Islamabad High Court on Monday summoned the Islamabad inspector general of police (IGP) in person on February 9 for not registering a first information report (FIR) against Central Intelligence Agency (CIA) former station chief Jonathan Banks over deaths of civilians in US drone attacks.

A single member-bench of Justice Shaukat Aziz Siddiqui resumed hearing of a contempt of court petition filed by Haji Abdul Karim Khan of North Waziristan, pleading that the Secretariat Police Station had not registered the FIR against the accused despite the order passed by the said bench on June 5, 2014.

During the course of proceedings, petitioner's counsel Mirza Shahzad Akber pleaded for contempt of court proceedings against the Secretariat Station House Officer (SHO) for not complying with court orders despite lapse of six months. He also requested the court to direct the Secretariat Police Station for registration of the FIR without any delay.

The court asked Secretariat SHO Nawaz Bhatti, who was present in the court, as to why the police failed to comply with the court order. Bhatti replied that a letter was written to the FATA secretariat by the Islamabad commissioner seeking legal opinion on the matter.

The FATA secretariat in reply said as the operation against militants was underway in South Waziristan, therefore, the case would be registered when situation normalized. He added that no proceedings could be initiated in the case. Later, the court summoned Islamabad IG Tahir Alam khan in person and adjourned the case till February 9.
