All petitions against 21st Amendment should be discarded: Federal govt

ISLAMABAD: The federal government on Monday submitted its reply to the Supreme Court (SC) which stated that all petitions filed against the 21st Amendment should be discarded. The SC will resume proceedings on challenges to the 18th and 21st Amendments tomorrow. The federal government in its written reply said that the 21st Amendment does not conflict with the legal framework of the constitution. On February 12, a three-member bench headed by Chief Justice (CJ) Nasir-ul-Mulk heard the petitions against the 21st Amendment. The federation as well as provinces had asked for time to submit responses in court. The CJ allowed 10 days to submit responses, adjourning the case till February 24. On January 6, the National Assembly approved the 21st Constitutional Amendment as well as amendment to Pakistan Army Act 1952. The 21st amendment provides constitutional cover to trial of offences relating to terrorism by military courts while amendment to the Pakistan Army Act, 1952 extends the jurisdiction of military courts to try terrorists. The Constitution (21st Amendment) Act, 2015 shall remain in force for two years from the date of its commencement and shall cease to be part of the Constitution and shall stand repealed on the expiration of the period.
