LHC to hear case to drop Musharraf’s name from official records

LAHORE: Chief Justice of the Lahore High Court (LHC), Ijaz Ahmed Chaudhry, on Monday overruled an objection raised by the court’s Registrar Office on a petition filed by former president Muhammad Rafiq Tarar for directions to drop all references made to Pervez Musharraf in public and official records describing him as the country’s president, and ordered that the plea be heard at the LHC’s principal seat.

On Monday, counsel for the petitioner, Abid Hassan Minto, argued that the LHC and IHC had concurrent jurisdiction in the matter and hence the former could also take up the petition. In the petition, Tarar’s counsel submitted that promulgation of emergency in October 1999 had been declared to have no legal effect as per the 18th Amendment Bill and that the orders issued in 2001 for Tarar’s expulsion also had no legal effect.

He requested the court to declare that Musharraf was not entitled to receive any privileges, as he was not an elected president. He prayed to declare that Tarar was entitled to receive salary from December 1, 2001, to September 8, 2009, and pension from September 9, 2008.
