Gilani Contempt case: SC appoints AG Irfan Qadir as prosecutor
ISLAMABAD: The Supreme Court (SC) on Friday allowed the newly appointed Attorney General Irfan Qadir to act as prosecutor in Prime Minister Gilani's contempt case, Geo News reported.The AG will start his arguments from Thursday (April 19) a day after the PM’s counsel in the case Aitzaz Ahsan concludes his arguments.
During proceedings of the case, the newly appointed Attorney General sought time for preparation relating to his assisting the court in the case.
Justice Nasirul Mulk remarked that Maulvi Anwarul Haque was the prosecutor in the case, but Aitzaz Ahsan intervened and informed the court that it was not the individual rather the Attorney General who was the prosecutor according to the rules.
To this Justice Nasirul Mulk said that the prime minister himself appointed his own prosecutor and whether such assertion was not a violation of the Article 10-A pertaining to a fair trial.
Later, Justice Ijaz Ahmad Chaudhry giving remarks said that the Attorney General has been changed by a person against whom the contempt of court case was in process and whether such accuse should be permitted to appoint a prosecutor of his liking.
Justice Ejaz Afzal Khan remarked that if the contempt of court case was against the Attorney General himself, then whether he should be made the prosecutor.
When Irfan Qadir on the prosecution issue wanted to speak, the court stopped him, while Aitzaz Ahsan said that until ascertaining of the prosecutor, he would not further argue.
The court said that Maulvi Anwarul Haque has been called and the prosecutor issue would be discussed later, meanwhile Aitzaz was asked to continue his arguments.
