Supreme Court justifies dispatching its orders in PM’s case
ISLAMABAD: Supreme Court Registrar Dr Faqir Hussain on Sunday clarified that dispatching of orders in the prime minister’s contempt of court case to the National Assembly speaker was in accordance with the court’s regular practice under the Supreme Court Rules 1980 and there was nothing improper in following that procedure.
A statement issued from the Supreme Court said that the court’s orders, without any exception, were forwarded to the authorities and departments concerned for implementation and compliance. Two orders were passed on April 26 in the contempt of court case against the prime minister for not implementing the court’s judgement in the NRO case.
The statement followed after news appeared quoting Law Minister Farooq H Naek taking exception to the letters of Supreme Court assistant registrar addressed to the National Assembly speaker the Election Commission of Pakistan, etc.
The law minister had termed the move unconstitutional and said a privilege motion would be moved against it in the National Assembly. He had said the letter written by the SC assistant registrar to the National Assembly speaker, Cabinet Division secretary and chief election commissioner was misuse of his power, adding that the Supreme Court must hold an inquiry into it.
“The letter called for further action by the speaker, cabinet secretary and the chief election commissioner, although the court’s short order contained no such directions,” Naek had said. It was a prerogative of the National Assembly speaker and Senate chairman to send references to the Election Commission for disqualification of a parliamentarian. staff report
