Bench formed to hear Musharraf treason case

ISLAMABAD: The Supreme Court has constituted a three-member bench to resume the hearing of five identical petitions against former president General (r) Pervez Musharraf for subverting and holding in abeyance the constitution.
A bench, headed by Justice Jawwad S Khawaja, includes Justice Khilji Arif Hussain and Justice Eajaz Afzal Khan, which will take up the matter tomorrow (Monday). Justice Jawwad S Khawaja is from Punjab, Justice Khilji is from Sindh and Justice Eajaz Khan is from Khyber Pakhtunkhwa.
Earlier, an application had been moved on behalf of Raja Muhammad Ibrahim Satti, the counsel for Musharraf, in Civil Petition No 2255 of 2010, arising out of a judgement dated 14-10-2010 and passed by two judges of the Sindh High Court, whereby a petition under Article 199 of the constitution has been dismissed. The chief justice of Pakistan, while passing an order, said that under Order XI of the Supreme Court Rules, 1980, petitions for leave to appeal ordinarily are to be heard and disposed of by a bench of two judges, but the chief justice, in a fit case, can constitute a bench comprising not less than three judges.
There are also other petitions, filed under Article 184(3) of the constitution, which shall also be heard and disposed of by a bench, consisting of not less than two judges, under Order XXV, Rule 2 of the Supreme Court Rules. Meanwhile, a complaint, Aslam Ghumman, who got an FIR registered against Musharraf for detaining more than 60 judges in their residences, has decided to file petition in the Islamabad High Court tomorrow (Monday) against the capital police for not contacting him in a case in which Musharraf’s bail had been rejected last week.
