Musharraf clamped emergency over PM’s ‘secret’ letter, SC told
ISLAMABAD: The counsel for former president Pervez Musharraf has contented before the Supreme Court that November 3, 2007 emergency was declared on the basis of a “top secret” letter by the then prime minister Shaukat Aziz and the same proclamation contained the names of the functionaries who were taken on board and were also party to it, therefore Musharraf could not be solely held responsible.
Submitting 20 legal propositions/questions of law, which mostly related to composition of a larger or full court for the hearing of the case, Ibrahim Satti on behalf of Musharraf also stated that chief justice of Pakistan had personal bias against his client, therefore, the senior-most judge should constitute a larger bench as done in Asad Ali’s case. A three-member bench headed by Justice Jawwad S Khawaja and comprising Justice Khilji Arif Hussain and Justice Ejaz Afzal heard the case pertaining to the subversion and abrogation of constitution through the imposition of emergency on November 3, 2007 in the country by the former dictator. Satti also said that the former president’s name was placed on the Exit Control List (ECL) without following the legal procedure, and contended that restricting his free movement is a violation of law. He stated that currently Musharraf has no desire to go out of the country, but his mother was sick and was in Dubai therefore he may like to visit her.
