Appointment of new AGP challenged

Staff Report

ISLAMABAD: The appointment of Attorney General Justice (r) Maulvi Anwarul Haq – named to the post on Tuesday – was challenged in the Supreme Court on Wednesday. The petition was filed by advocate Chaudhry Muhammad Aslam Ghumman.

The petition filed under Article 184(3) of the constitution states that Justice (r) Anwarul Haq, under Article 100, did not fulfil the requirement to be appointed as the attorney general, as he was admittedly a contemnor, who deliberately violated the Supreme Court’s November 3, 2007, order and took oath as a judge of the Lahore High Court under the Provisional Constitutional Order (PCO).

The petitioner stated that the AG had resigned as an LHC judge in remorse of taking oath under the PCO, thus he was not entitled to be appointed to the post.

The petitioner requested the court to set aside the notification for the appointment of Maulvi Anwarul Haq as the AG.

The post of AG had fallen vacant after the resignation of Justice (r) Anwar Mansoor Khan on April 2.
