SC irked by inaction on implementation of NRO verdict : Should PM be issued notice, Supreme Court asks DAG

* Justice Fayyaz says PM represents govt, responsible for ensuring implementation

ISLAMABAD: Expressing dissatisfaction over the non-implementation of the Supreme Court verdict on the National Reconciliation Ordinance, Justice Raja Fayyaz Ahmed, a member of the apex court’s five-judge larger bench, on Thursday questioned if the court should issue notices to the prime minister regarding non-implementation despite a lapse of four months?

He said, “The prime minister represents the government, so it’s his responsibility to ensure implementation of the NRO verdict. What is happening?” he questioned. The bench comprising Justice Nasirul Mulk, Justice Raja Fayyaz Ahmed, Justice Jawwad S Khawaja, Justice Rahmat Hussain Jafferi and Justice Tariq Parvez was hearing a suo motu case against non-implementation of the NRO verdict.

During the proceedings, the court questioned, “Why are the government functionaries delaying the implementation of the NRO verdict?”

“What about compliance with the court’s orders?” Justice Fayyaz asked when Deputy Attorney General Agha Tariq Mehmood sought more time for the implementation of the verdict.

The DAG had earlier submitted a report stating that an inquiry was conducted to fix responsibility on the government officials responsible for promoting former FIA deputy director Ahmed Riaz Sheikh to additional director general (Economic Crimes Wing) after the NRO verdict, despite him being one of the beneficiaries.

The deputy attorney general said Establishment Division Additional Secretary Tahir Sarfraz was found guilty of promoting Ahmed Riaz to additional director general (Economic Crimes Wing), but added that Tahir had moved an application before the PM and objected to the credibility of the inquiry against him.

He told the court that the prime minister had ordered a fact-finding inquiry into the matter, but a copy of the order could not be procured. Justice Nasirul Mulk said the documents regarding the developments in the case should be submitted to the Supreme Court before the next hearing.
