Plea for PM’s disqualification: SHC issues notice to AG
Karachi: A division bench of the SHC, headed by Justice Maqbool Baqir Monday, issued notice for date in office to attorney general in petition praying for Prime Minister (PM)’s disqualification.
Petitioner Maulvi Iqbal Haider impleaded Prime Minister Yousaf Raza Gilani, Speaker National Assembly, Chief Election Commissioner and Federation of Pakistan through Secretary Ministry of Law, Justice and Parliamentary Affairs.
He submitted prime minister violated Article 63(1) (g) r/w, Article 5 and other articles of the Constitution with what he claimed making derogatory remarks in his speeches in parliament against the Army with mala fide intention despite pendency of Memo petitions in the Supreme Court.
Ban on rallies, meetings on roads: Another division bench of the SHC Monday issued notices to respondents in a constitutional petition seeking ban on holding rallies and public meetings on busy roads of the city. The petition, filed by human rights activists Rana Faizul Hasan and Imran Shahzad jointly against the rallies, taken out on busy roads, including MA Jinnah Road, Shahrah-e-Faisal and roads around Empress and Regal markets in Saddar area.
They submitted that day-to-day rallies taken out on these roads cause traffic jam and people face hardship in free movement thus it is a clear violation of fundamental rights under Article 8 of the Constitution of Pakistan. The petitioners prayed the court to direct the respondents to impose ban on these activities in view of inconvenience to general public. They further prayed the court to direct respondents to ban political activities on Mazar-e-Quaid on national days like 23rd March, 14th August and 25th December.
After initial hearing, the bench comprising Justice Maqbool Baqar and Justice Muhammad Ali M Mazhar ordered issuance of notices to the respondents including chief secretary, home secretary, commissioner Karachi and administrator Karachi for a date to be fixed in office. agencies
