Decisions, not clarifications, elevate courts: Aitzaz
LAHORE: Pakistan People’s Party Senator and former Supreme Court Bar Association President Chaudhry Aitzaz Ahsan said on Monday the trust in courts is established through verdicts, and not clarifications.
He was referring to Chief Justice Mian Saqib Nisar’s address in which he said the judiciary is like a Baba (elder), whose advice everyone seeks, and urged the public to stop doubting the integrity of the judiciary and criticising it for its verdicts against them.
Aitzaz said the Supreme Court dealt with the Sharif family in the Hudaibiya Paper Mills case leniently. The family was given a big concession. “No one has been given such a concession in criminal cases, because as per the law, investigation cannot be ignored in such cases.”
The CJ had said that he did not know that the Hudaibiya Mills case was also fixed for announcement on Friday, the same day when the petition seeking the disqualification of Imran Khan and Jahangir Khan Tareen was decided.
Ch Aitzaz said that time period had been specified for cases of civil nature, but not in the criminal cases. “If an accused in a 20 years old murder case is convicted and awarded sentence, then why not an accused in a criminal case,” Aitzaz said.
“How a matter of money laundering or fraud could expire?” he asked. He said the LHC’s decision was wrong in the Hudaibiya case and now the SC decision was also not understandable. Aitzaz said he was still thinking that what reasonswould be given in the SC decision. A corruption allegation is sufficient to dissolve the PPP government, while the Nawaz Sharif’s government was still there even after corruption was proved. He said the Sharif family was dealt with leniently.
Aitazaz also cited the 1997 attack by the PML-N at the SC. Jahangir Tareen provided the money trail, while Nawaz instead of giving the money trail submitted a fake Qatari letter, added Aitzaz. “How a British prime minister can be the general manager of Koh-i-Noor Textile Mills?” Aitzaz questioned Nawaz Sharif’s role in the FZE Company based in the UAE. “They say they have been sentenced on Iqama and not over Panama,” he said. Aitzaz said that ‘Iqama’ is a serious offence.
Commenting on the chief justice’s speech, Aitzaz said that he (CJ) was seen in anger, though he was a humble person. Meanwhile, former president of Supreme Court Bar Association (SCBA) Asma Jahangir said here on Monday that respect is earned by one and not exacted from others. Commenting on statements of the chief justice he made during his speech on Sunday, she said there should not be the need for the judiciary to prove its transparency, but criticisms would come about if judges compare petitioners with a mafia.
While speaking to the media here on Monday, she said people do criticise institutions but it was not right for the judiciary to give clarification of its actions, according to Geo News report. She said democracy and supremacy of the law run parallel to each other. Asma said it would not be right to say that the top court is a corrupt institution. But, she added, where the petitioner would go if the apex court did not give fair treatment.
