SC refuses to stop proceedings against PCO

ISLAMABAD: The Supreme Court on Monday rejected Justice (r) Abdul Hamid’s plea for stopping proceedings against PCO judges. A four-member bench of the apex court headed by Mahmood Akhtar Shahid Siddiqui and comprising Justice Jawwad S Khawaja, Justice Tariq Parvez and Justice Khilji Arif Hussain was hearing the contempt of court case against PCO judges, who had violated the Novermber 3, 2007 judgement and taken oath under the PCO. During the course of proceedings, counsel for Justice (r) Dogar, Ibrahim Satti, argued that there was no contempt of court law in the country.
He said that Dogar’s petition in the contempt of court was still pending before a 16-member bench and he had pleaded the court to first decide on the law, which was applicable on contempt of court. However, the apex court rejected his plea.
Satti requested the bench to give more time for filing an appeal against the dismissal of his plea, adding that they would submit an application before the chief justice of Pakistan for the constitution of another bench for hearing Dogar’s appeal. “In the meantime, the court can hear the arguments of Dr Abdul Basit, counsel for Justice Hasnat Ahmed Khan and Justice Shahbar Raza Rizvi,” he said.
