Justice Osmani elevated to SC, Justice Mushir new SHC CJ

15 additional judges of LHC, PHC sent packing

* Judicial Commission recommends one-year extension to 24 additional judges of LHC

ISLAMABAD: The Judicial Commission on Saturday refused extension in service to 15 judges of high courts and nominated Sindh High Court Chief Justice Sarmad Jalal Osmani and Justice Amir Hani Muslim for their elevation to the Supreme Court.
This was the first meeting of the commission formed under the 19th Amendment. The number of judges in the commission was increased to nine after inclusion of Justice Tassadduq Hussain Jillani and Justice Nasirul Mulk in it. All of them attended the meeting.
According to sources, the commission gave a one-year extension to 24 judges of the Lahore High Court out of 34 while names of 10 judges have been dropped. They are Justice Mansoor Kokab, Justice Abdur Rehman Ansari, Justice Tariq Javed, Justice Naseem Akhtar Khan, Justice Muhammad Anwar Bahor, Justice Mian Shahid Iqbal, Justice Shaukat Omar Pirzada, Justice Ikhlaq Ahmed, Justice Waqar Hassan Mir and Justice Hassan Raza Pasha.
The sources said of seven judges of Peshawar High Court only two judges have been given extension, while names of five have been dropped.

The LHC judges who were given extension include; Justice Asad Munir, Justice Saghir Ahmed Qadri, Justice Nasir Saeed Sheikh, Justice Sheikh Najamul Hassan, Justice Khawaja Imtiaz Ahmed, Justice Manzoor Ahmed Malik, Justice Sardar Tariq Masood, Justice Ijazul Ahsan, Justice Syed Mansoor Ali Shah, Justice Chaudhry Muhammad Tariq, Justice Sheikh Ahmed Farooq, Justice Chaudhry Shahid Saeed, Justice Rauf Ahmed Sheikh, Justice Ijaz Ahmed, Justice Khalid Mehmood Khan, Justice Shahid Hameed Dar, Justice Mohammad Yar Ali, Justice Anwarul Haq, Justice Sardar Muhammad Shamim Khan, Justice Memon Rashid Sheikh, Justice Farrukh Irfan Khan, Justice Muhammad Qasim Khan, Justice Saeed Mazhar Ali Naqvi and Justice Mazhar Iqbal Sindhu.

The commission also recommended appointment of Justice Mushir Alam as chief justice of SHC and put off extension issue of nine judges till his oath taking.

Justice Osmani was the member of the 13-member bench of the apex court, which declared November 3, 2007 emergency as unconstitutional on July 31, 2009. He was promoted to the apex court when Abdul Hameed Dogar was the chief justice and according to July 31 decision, he had to go back to his position of November 2, 2007.

Meanwhile, sources said after the elevation of the two judges, the apex court would resume the hearing of 18th Amendment case

Balochistan High Court additional judges, including Justice Jamal Khan Mandokhel, Justice Tahira Safdar, Justice Muhammad Noor Meskanzai and Justice Ghulam Mustafa Mengal, have already been given extension in December.

The commission decided that after the approval of Justice Mushir Alam as chief justice Sindh High Court by the parliamentary committee, it would take up the issue of SHC additional judges in its next session.

Chief Justice Ifthikhar Muhammad Chaudhry, who is the chairman of the commission, presided over the meeting while Justice Javed Iqbal, Justice Mian Shakirullah Jan, Justice Tassadduq Hussain Jillani, Justice Nasirul Mulk, Justice (r) Chaudhry Ijaz Ahmed, Federal Law Minister Babar Awan, Attorney General Maulvi Anwarul Haq and Pakistan Bar Council representative Dr Khalid Ranjha and chief justices of all four high courts attended the meeting. The recommendations of commission will be forwarded to the parliamentary commission headed by Mian Raza Rabbani for approval.
