Unseated LHC judge regrets taking oath under PCO

ISLAMABAD: An unseated judge of the Lahore High Court, Sajjad Hassan Shah, has submitted an unconditional apology before the apex court, regretting his act of taking oath under annulled Provisional Constitutional Order (PCU) of November 3, 2007.
A four-member SC bench, comprising Justice Mehmood Akhtar Shahid Siddiqui, Justice Jawwad S Khawaja, Justice Arif Khilji and Justice Tariq Pervaiz, had been hearing contempt of court cases against a number of unseated judges of superior courts who took oath after the proclamation of emergency on November 3, 2007 despite a restraining order by a seven-member bench of the Supreme Court.
On Tuesday, Sajjad Hussain’s counsel, Zamir Sheikh, argued that his client was in Rawalpindi on November 3, 2007 and had no knowledge of the court’s order, adding, if he had learnt about it, he would have complied with it. Lahore High Court former chief justice Iftikhar Hussain Chaudhry’s counsel, Dr Khalid Ranjha, maintained that his client had not received the November 3 order either by fax, telephone or any other authentic mean.
