CJ speaks on concept of judiciary’s freedom


ISLAMABAD: The Supreme Court (SC) has been requested not to subscribe to the concept of basic structure of the Constitution, Geo News reported Tuesday.

The judges said in their remarks that if Parliament is active, so is the apex court as well, adding the new modus operandi for the appointment of judges is not part to the basic body of the Constitution.

A 17-judge bench of the apex court heard today the petitions against 18th Amendment.

The federal government’s counsel Wasim Sajjad argued that the Constitution could not be reviewed by basing Article-2A relating Objective Resolution.

Responding the argument, Justice Khalilur Rehman Ramday observed that the Article-2A stipulates the basic structure of the Constitution.

Wasim quipped, ‘It is a political question to delineate the features of the Constitution and the Parliament is authorized to settle it. And, it is only the parliament to decide as to which part of the Constitution is non-amendable.’

Justice Ramday addressed Sajjad, ‘You are advocating the Parliament to embark on the wrong and people to take to streets, ensuing bloodbath and that people get the decision supercede d with force.’

He added asking the counsel as to the country where judges are imprisoned.

Giving his remarks, Chief Justice of Pakistan Justice Iftikhar Muhammed Chaudhry said the independence of judiciary does not mean to save the jobs of judges; instead, it indicates the people’s trust on the judiciary.

Wasim Sajjad urged the judiciary against contributing to the concept of basic structure of the Constitution, as it would not lead to good consequences.

Justice Asif Khosa said in his remarks if the purpose is the independence of judiciary; then its procedure should not be part of the basic body of the Constitution.

The hearing has been adjourned till tomorrow.
