SC moved for decision on plea against Shahbaz
* Petitioner seeks verdict in case for disqualification of incumbent Punjab CM
ISLAMABAD: A petition has been moved in the Supreme Court seeking its judgement on the three-year-old case related to the disqualification of the incumbent Punjab chief minister, Shahbaz Sharif, regardless of expiry of the term of the Punjab Assembly on March 26.
Appellant Shahid Orakzai alleged in his application that “complete justice” was not done to him against Shahbaz Sharif who is ruling the biggest province of the country, saying on March 11 he was told that the chief justice of Pakistan did not entertain his plea for a larger bench in the case. The appellant pointed out that the application for a larger bench had been filed by him in the court and not in the chamber of the chief justice, “making it clear that an order in the chamber was not acceptable to him”.
He recalled that the chief justice had fixed the same case before a seven-member bench presided over by himself, and the appeal was heard twice by a five-member bench. An order signed by the five judges was attached as a proof with the application filed on Thursday. The appellant said the action of the chief justice had suited Shahbaz Sharif, whereas the three judges had unanimously rejected his stance in the court and endorsed the appellant’s view that the case was of first impression and the leave-granting order had emphasised the need for an “authoritative judgement”.
Orakzai stated on oath that the chief justice had told him that his appeal had become infructutous and he should try his luck in the next general election. In response the appellant produced a notification of the election commission acknowledging that the result of by-election in PP-10 Rawalpindi was subject to the decision of the Lahore High Court which was moved by Orakzai through a writ petition.
It must be noted that the Supreme Court had already refused to entertain his petition against the SC registrar, Dr Faqir Hussain, saying that scandalous language is used in it. Orakzai requested the court to restrain Dr Hussain from performing his duties and appoint another officer in lieu of him until the decision on the three-year-old case related to the disqualification of the incumbent Punjab chief minister, Shahbaz Sharif. hasnaat malik
