Commission formed to ensure implementation of 18th Amend

ISLAMABAD: Senator Raza Rabbani has been made the chairman of the Commission for the Implementation of the 18th Amendment, while Senator Ishaq Dar of the Pakistan Muslim League-Nawaz will be the deputy chairman.

A notification issued by the Cabinet Secretariat late on Tuesday states that the commission – to ensure implementation of the 18th Amendment – would have the authority to hire experts, serving or retired members of the civil services or anyone else for a specified purpose and time on terms and conditions the commission may deem fit, but with the government’s approval.

The commission is also empowered to make or issue such directions, undertake proceedings or require the making of amendments to regulations, enactments, notifications, rules or orders as may be necessary to advance the objectives of Clause 8 of Article 270(AA) of the constitution. For this purpose, it may also require the attendance of any official of the federal or provincial governments or the divisions or the attached departments/offices.

Raza Rabbani being the chairman has been given the commission’s execution authority and would be responsible for supervising the affairs of the commission, including implementation of the objectives, policies, decisions and directives of the Implementation Commission, either directly or through the officers of the federal and provincial governments, the divisions and the attached departments/offices. The commission is bound to submit bi-annual reports to parliament on the progress of implementation of its objectives.

Functions of the commission include taking steps necessary for the implementation of Clause 8 of Article 270(AA) and others needed for the implementation of the 18th Amendment; examining the policy, programmes, capacity-building and other measures required to be taken by the federal and/or provincial governments for the implementation of the devolution process. The commission would also review all laws and rules being affected as a consequence, create and monitor the mechanism and institutional procedures required to complete the process of devolution by June 30, 2011, access the financial implications of such devolution and provide guidance for financial mechanism that will make it sustainable.
