SC moved for inquiry into plane hijacking case

LAHORE: A petition was moved before the Lahore Registry of the Supreme Court on Friday, seeking a judicial inquiry into the plane hijack case registered against former prime minister Nawaz Sharif by then chief of army staff Parvez Musharraf and bringing the responsible to the book.

Najma Ahmad, a resident of Johar Town, Lahore, filed the petition stating that in 1999, Pervez Musharraf had visited Sri Lanka to attend the Golden Jubilee Ceremony of the Armed Forces of Sri Lanka.

She stated that on November 12, flight No PK 805 of the PIA was to fly from Colombo to Karachi at 1:20pm, but the airport controller allowed it at 8:45pm. She stated that on the same day, at around 10am, Nawaz Sharif had terminated Musharraf and appointed Ziauddin Butt as the COAS.

She said that at that time Musharraf was in the plane and after being informed about his removal, he refused to accept the order of the PM.

She stated that to receive Musharraf, around 200 army men were deputed at the airport, 200 at the radio station and many at the PTV station when the former army chief reached Karachi at 8:45pm.

By that time, Nawaz Sharif was arrested. She stated that at around 2:25, Musharraf had addressed the people of Pakistan and surprisingly the FIR for alleged hijacking was registered against Nawaz Sharif after 29 days, accusing him of hijacking a plane.

She stated that Musharraf toppled a democratic government and had held in abeyance the constitution.

She stated that on gunpoint, the armed forces of Pakistan had conquered their own people against the larger interest of the country.

The petitioner stated that the unconstitutional act of the respondents whereby an elected and democratic government had been thrown away and the representative of people were put behind bars for no offence by an illegal and unconstitutional act had had disastrous effects.

She said the country was later pushed into so-called war on terror, which claimed so many precious lives of innocent Pakistanis.

She stated that this act of Musharraf and other army generals was unconstitutional, rather tantamount to high treason.

She stated that Nawaz Sharif, being a prime minister, was fully authorised to terminate the army chief and Musharraf was duty bound to obey the order of the PM and had no legal right to exercise his power as the army chief after his removal.

She requested to issue directions for constitution of a judicial commission for holding an inquiry regarding the matter in question and bring the responsible to the book.

She made then army generals, including Lt Col Attiquzzaman, Lt General Usmani, Major Zafarullah Khan, Lt General Muhammad Aziz, Lt General Mahmood Ahmad and Lt General Nasir Ahmad respondents in her petition.
