Judges Appointment:SC raises 4 questions
ISLAMABAD:The Supreme Court of Pakistan raised four questions during the hearing of a case pertaining to appointment of judges in the Islamabad High Court, Geo News reported.
A four-member bench of the apex court headed by Justice Khilji Arif Hussain was hearing the case on Thursday.
Justice Khilji asked; Did formation of Judicial Commission was correct, what will be the credibility and the effects of the recommendations the commission came up with, to what extent presence of absent member could have effected overall decision of the commission, can president stop appointment on a post recommended by prime minister through a summary and what should be done if there was no constitutional provision, providing answers to the above three questions.
The questions came as the bench was told that the Justice Riaz Ahmed Khan was on Haj when the meeting of the Judicial Commission took place.
However, he said that Justice Anwar Kasi had attended the meeting, who was the senior most judge after Mr Khan.
The bench ordered the Attorney General to apprise the president that Justice Riaz Ahmed Khan was not present in the country at the time of commission’s meeting.
Justice Khilji Arif Hussain said it was possible that the president might not have been informed that Mr Khan was abroad during the meeting.
The AG contested that the Judicial Commission had not informed the president about facts.
