PM orders drafting of reference for SC on IHC judges’ appointment

ISLAMABAD: Prime Minister Raja Pervez Ashraf on Monday directed Law Minister Farooq H Naek to prepare a reference to be filed by the president before the Supreme Court to seek opinion in the matter of appointment of judges in superior courts to settle all issues in a transparent manner as per the constitution.
He gave these directives in a meeting with the minister who called on him at the PM’s House and discussed the forthcoming reference at length.
During the meeting, questions to be posed to the Supreme Court for its opinion were discussed in detail. The PM said the government had always abided by the constitution and taken recourse to constitutional remedies whenever one of the organs of the state or a point of law was under question.
Appreciating the advice given by the law minister for filing of a reference in the Supreme Court, the premier said it will not only further improve relationship with the judiciary, but also bring clarity to the process of appointing judges. He added it will also reaffirm the government’s policy that all institutions should work in harmony and in consultation with each other without interfering in each other’s affairs.
Raja expressed the confidence the filing of reference will enhance the respect for state institutions among the common man, which will strengthen both democracy and the institutions.
It is pertinent to mention that the government intends to file a reference in order to obtain the advice of the Supreme Court under Article 186 of the constitution, inter alia, with regards to the appointment of chief justice of the Islamabad High Court as well as confirmation of judges of the IHC.
