JCP must stop judges’ appointments until CJP’s retirement: PBC

ISLAMABAD: The Pakistan Bar Council (PBC) on Tuesday demanded the Judicial Commission (JCP) stop appointment of superior courts’ judges until the retirement of Chief Justice of Pakistan Iftikhar Muhammad Chaudhry.
PBC Vice Chairman Syed Qalb-e-Hassan said the legal fraternity has noted with concern that quarters concerned are contemplating appointment of more judges in high courts, and in that pursuit the Judicial Commission of Pakistan may complete and finalise the process within a couple of weeks. He said propriety and appropriateness demand that appointment of more judges to superior courts should not be undertaken by the JCP with its present composition in view of the fast approaching retirement of the present chief justice of Pakistan, who is also the chairman of the commission, on December 11.
The PCB chairman said that in view of the reservations constantly expressed by the legal fraternity on appointments of judges by the Judicial Commission of Pakistan in the past, it is desirable that the matter of appointment of more judges of high courts should be taken in hand and dealt with by the Judicial Commission of Pakistan to be headed by the new chief justice of Pakistan. He said the Pakistan Bar Council particularly and members of the Bar generally are perturbed because of “inaction of Judicial Commission of Pakistan” in respect of amendments in the Judicial Commission of Pakistan Rules, 2010 proposed by the Pakistan Bar Council in March 2013. He said despite lapse of eight months the proposed amendments in the rules have not been carried out, although a number of meetings of the judicial commission were held since then. staff report
