‘Govt not bound to consult CJP on NAB chief appointment’

By Hasnaat Malik

ISLAMABAD: Senior leaders of People’s Lawyers Forum (PLF) have observed that appointment of chairman NAB without the consultation of Chief Justice of Pakistan would not be illegal.

Talking to Daily Times, PLF president Raja Abdul Rehman said that though the court in its recent judgments had asked the government to appoint the chairman NAB with the consultation of the CJP but there was no provision in the law that the government would be bound to consult the CJP regarding the matter.

PLF president also mentioned that the government’s review petitions were pending regarding those two judgments, in which the court had directed it to consult the chief justice about the appointment of chairman NAB. Another senior PLF leader Ramzan Chaudhry said that the government was not bound to consult CJP about the matter.

Renowned lawyer Tariq Mahmood also backed the PLF stance that the government was not bound to consult the CJP under the law but stated that the court in its two recent judgment (NRO case, Deedar Shah case) stressed the government to consult the chief justice. A high official revealed to Daily Times that the government would consult the CJP about the appointment of new chairman NAB. He also mentioned that PPP senior leader Chaudhry Aitzaz Ahsan had recommended the president to appoint Fasih Bokhari as chairman NAB.
