Nisar moves SC against appointment of NAB chairman
ISLAMABAD: Opposition Leader in the National Assembly Chaudhry Nisar Ali Khan has moved Supreme Court (SC) Saturday against the procedure adopted for the appointment of Admiral (r) Fasih Bokhari as chairman NAB by government. On behalf of the petitioner senior counsel Akram Sheikh on Saturday filed a constitutional petition under Article 184(3) of the constitution, making federation of Pakistan through secretary of law, government of Pakistan through secretary of establishment division and Bukhari as respondents. The court has been requested that Bukhari be graciously restrained from performing the functions as chairman NAB with immediate effect, till the final adjudication of the petition in the larger interest of rule of law, independence of judiciary and for the enforcement of judgment of SC in the case of Shahid Orakzai vs Federation of Pakistan, PLD 2011 SC 365 for the protection of parliamentary democracy and most importantly for increasing the faith of people of Pakistan in the accountability process. The petitioner stated that Chief Justice of Pakistan (CJP) was not consulted before notifying the appointment of chairman NAB despite various judgments of apex courts in this connection deeming the CJP to be a valid consultee. The petitioner contended that Asif Ali Zardari was disqualified from exercising any powers or performing any function with regard to the appointment of Bukhari keeping in view the oath of his office whereby he has sworn not to allow his “personal interest” influence his official conduct. “Zardari who is accused in more than a dozen cases of alleged corruption within and outside Pakistan has obvious conflict of interest in such appointment. staff report
