The Judges’ Oath

Justice (Retd) K M A Samdani in his article in The Nation (March 12, 2008) has stated, "Our country is on the brink of an apocalypse. It has come to such in the ultimate analysis, only because of the failing of our judiciary. Are the lawyers aware of this? I wish them every success in their current movement which has also gained support from some of the political parties. But what they are trying to achieve is only the tip of the iceberg. What about the judges who refused to take oath under the PCO of 1999 and chose to adhere to their constitutional oath? In my opinion, they are still judges if they have not crossed the upper age limit of 65 years, including the then chief justice, Mr Justice Saeed uz Zaman Siddiqui. Those of them who have already reached the upper age limit of judges of the Supreme Court, are entitled to their salaries and other benefits until they reached such limit. “
